i think im gonna lose my barn space

i moved into a house that has a lot of land in the back yard and a attached garage, that is shared by the landlord, and a old barn.
well i went through and winterizedthe barn enough to run a kerosene heater and work on the blaster. been using it all winter, and today the landlord called up and said she wants to come check out the barn and another cottage thats also on the property but not included in the rental.
says she rents the barn to a painter.
so i tell her ive been using the barn cause i thouht it was included, never any mention of somebody else renting it until today, been here since october. never seen anybody come by and when i went in it was full of junk. old paint can, garbage, broken stuff,etc...nothing really usable, looked like a dump site.
so i cleaned it up a bit, moved all the junk into a corner and blocked it off with a tarp. made it look like a good place to work on stuff out of the weather.
am i in the wrong for using this space because i rent the property? the electricity in the barn is in my name as it comes from the breaker box in the house, which i pay the bill for.
 
If it's not included in the rental agreement, take your tarp and stuff down.

It's not yours... and you're trespassing by being in there.

If you pay the bill for the power meter on that house and the power line out to the barn is on its own breaker, I would turn that breaker off and lock the breaker box.

Unless the landlord wants to let you and the "painter" work out an agreement where he lets you use space for the supply of power...
 
the lease doesnt seperate out buildings or anything for that matter. just says"Landlord hereby leases and lets tenant the premises as follows; property at ( my address). no specifications on whats being rented.
 
just talk to the painter dude and say hey ill pay the electric for the use of the space..if hes not a douche he will be fine with it
 
in my opinion i dont blame u for doing what u did, im sure there is no problem with you jsut cleaning up a little bit. but now that she has stated that its not included then its not included, its her property and you only rent it. by the way you describe it though i dont see why you cant just talk to the painter or the landlord about using a little of the space.

is it a residential rental agreement or commercial agreement. If residential, then usually that means the house and any attached out buildings. If commercial, then it might include all buildings on the tax lot. if she is not including the barn and it's electrical power is serviced from your meter/breaker panel, turn it off. If the painter needs power, let them buy a generator or work something out with you. but be carefull with that. you dont need the painter running some "all night" power robbing device there that sucks you out of $50-100/month in juice.
 
yep, just wait and see what develops, if you get ousted from the barn, your electric comes with you, not only would i turn off the breaker, i'd pull the wire from it also,
hopefully you can store the blasty in the "shared" garage ???
 
You technically don't have any rights if it is not specified in your rental agreement, although I have rented houses in Idaho (laws are probably not the same) and if you pay for the power it would technically fall under your rental property. If you get kicked out of the barn it is your legal right to be able to require them to provide separate power to the barn. The law here would side with the fact that if you are not allowed to use it they cannot require you to pay utility fee for it whether it is written or not. This is implied renters law i.e. if you lived in an apartment building they cannot require you to pay power for lights in building outside of your apartment.
 
I think you're both wrong and both right. There is too much ambiguity to determine who can do what and the wiring is ambiguous. At any rate, just talk it over with the painter guy and landlord and see how you can clean things up. If not, just put a tarp on the Blaster. A tarp probably gives it more protection than sitting in a barn anyways.
 
okay so met with the landlord, everything went okay, i didnt get into trouble for using the barn but had to get my stuff out, she really liked how clean it was and said that the painter just kinda threw everything in there and was sloppy. said she rents it to him for 50 /month. he hasnt paid in about 5 months so thats why it was offered as an add on to my rent. told her to get in touch with the painter so i dont step on his toes. but i got all my stuff moved into the garage now. tight fit and no room to work.
 
Hopefully the painter continues not to pay it and she'll let you give her another $50 a month as rent for the barn. You then have a clean, clear, and legal place to work.
 
i probably would have asked before using it, but i really wish that i had an option of somewhere to work on/store my stuff
 
brando...i did say i was going to use it at move in, they never said anything then. i would have thought that to be a good time to mention.
